In accordance with the provisions of Emergency Ordinance No. 34/2014 regarding consumer rights in contracts concluded with professionals, any customer who has purchased products online from the website belonging to “Society for Business Excellence” has the right to withdraw from the distance contract within 14 days.
A distance contract is defined as a contract for the supply of goods or services concluded between a trader and a consumer, within a system of sales organized by the trader, which exclusively uses one or more means of remote communication before and at the conclusion of this contract.
The customer has the right to unilaterally terminate the distance contract within 14 days, without penalties and without citing any reason.
The 14-day return policy applies only to customers who have purchased products online from the “Society for Business Excellence” websites and does not apply to customers who have received full consultancy, on-site visits, Dialux projects, samples, etc.
The right to cancel a purchase does not apply to legal entities. The 14-day period for exercising this right begins from the date of receipt of the last product in the order.
Obligations of the Professional in Case of Withdrawal
The professional refunds all amounts received from the consumer, including, where applicable, delivery costs, without undue delay and, in any case, no later than 14 days from the date on which they are informed of the consumer’s decision to withdraw from the contract, in accordance with legal provisions.
The refund is made via bank transfer (IBAN) as provided by the consumer, without the consumer bearing any commission fees related to the reimbursement.
However, the professional is not obligated to refund any additional costs if the consumer has explicitly chosen a different type of delivery than the standard delivery offered.
Unless the professional has offered to collect the goods themselves, in the case of sales contracts, they may withhold the refund until they receive the returned products or proof that the consumer has sent the products, whichever comes first.
Consumer Obligations in Case of Withdrawal
According to Ordinance No. 34/2014, the consumer bears only the direct costs related to returning the products unless the professional agrees to cover those costs or has failed to inform the consumer that they are responsible for these costs.
For contracts concluded outside commercial premises, where products were delivered to the consumer’s home at the time of contract conclusion, the professional must collect the products at their own expense if the nature of the products makes it impossible to return them via regular mail.
The returned products must be in good condition and in their original packaging.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the following cases:
- Service contracts after the complete performance of the service, if execution began with the consumer’s prior express consent and acknowledgment that they lose their right to withdraw once the service is fully performed.
- Supply of goods or services whose price depends on financial market fluctuations beyond the professional’s control, which may occur during the withdrawal period.
- Supply of goods made to the consumer’s specifications or clearly customized.
- Supply of perishable goods or products that expire quickly.
- Supply of sealed goods that cannot be returned for health or hygiene reasons and have been unsealed by the consumer.
- Contracts where the consumer has explicitly requested the professional to visit their home to carry out urgent repairs or maintenance. If additional services are provided beyond what the consumer explicitly requested, the right of withdrawal applies only to those additional services or products.
- Contracts concluded in an auction.

Conform dispozitiilor Ordonantei de Urgenta nr.34/2014, privind drepturile consumatorilor in cadrul contractelor incheiate cu profesioniştii orice client care a achizitionat online produse comercializate pe site-ul apartinand ASOCIATIA “SOCIETY FOR BUSINESS EXCELLENCE (SOCIETATEA PENTRU EXCELENTA IN AFACERI)” are dreptul de a denunta contractul la distanta in termen de 14 zile .
Prin contract la distanta se intelege contractul de furnizare de produse sau servicii incheiat intre un comerciant si un consumator, in cadrul unui sistem de vanzare organizat de catre comerciant, care utilizeaza in mod exclusiv, inainte si la incheierea acestui contract, una sau mai multe tehnici de comunicatie la distanta.
Clientul are dreptul de a denunta unilateral contractul la distanta, in termen de 14 zile, fara penalitati si fara invocarea vreunui motiv.
Dreptul de retur in 14 zile se adreseaza doar clientilor care au achizitionat produse online de pe site-urile ASOCIATIA “SOCIETY FOR BUSINESS EXCELLENCE (SOCIETATEA PENTRU EXCELENTA IN AFACERI)” si nu se adreseaza clientilor care au beneficiat de consultanta completa, deplasari la domiciuliu/proiect/lucrare, proiecte dialux, monstre etc.
Dreptul de renuntarea la cumparare nu se aplica in cazul persoanelor juridice. Termenul de 14 zile prevazut pentru exercitarea acestui drept incepe sa curga: data primirii ultimului produs din comanda.
Obligaţiile care revin profesionistului in cazul retragerii:
Profesionistul ramburseaza toate sumele pe care le-a primit drept plata din partea consumatorului, inclusiv, dupa caz, costurile livrarii, fara intarziere nejustificata şi, in orice caz, nu mai tarziu de 14 zile de la data la care este informat de decizia de retragere din contract a consumatorului in conformitate cu dispozitiile legii.
Profesionistul ramburseaza sumele menţionate prin OP in contul IBAN furnizat de catre consumator fara a fi in sarcina consumatorului plata de comisioane necesare rambursarii.
Fara a aduce atingere primului paragraf al prezentei sectiuni, profesionistul nu este obligat sa ramburseze costurile suplimentare in cazul in care consumatorul a ales in mod explicit un alt tip de livrare decat livrarea standard oferita de profesionist.
Cu excepţia cazului in care profesionistul s-a oferit sa recupereze el insuşi produsele, in cazul contractelor de vanzare, profesionistul poate amana rambursarea pana la data recepţionarii produselor care au facut obiectul vanzarii sau pana la momentul primirii unei dovezi din partea consumatorului conform careia acesta a trimis produsele catre profesionist, luandu-se in considerare data cea mai apropiata.
Obligaţiile consumatorului in cazul retragerii
Conform Ordonantei nr. 34/2014, consumatorul suporta doar costurile directe legate de returnarea produselor, cu excepţia cazului in care profesionistul accepta sa suporte acele costuri sau in care profesionistul nu a informat consumatorul ca aceste costuri trebuie suportate de consumator. in cazul contractelor in afara spaţiilor comerciale, in cazul carora produsele au fost livrate la domiciliul consumatorului la momentul incheierii contractului, profesionistul preia produsele pe cheltuiala sa daca produsele, prin natura lor, nu pot fi returnate in mod normal prin poşta.
Produsele trebuiesc sa fie returnate in stare buna si in ambalajele originale.
Exceptari de la dreptul de retragere
Sunt exceptate de la dreptul de retragere, in ceea ce priveşte contractele la distanţa şi contractele in afara spaţiilor comerciale urmatoarele:
– contractele de prestari de servicii, dupa prestarea completa a serviciilor,daca executarea a inceput cu acordul prealabil expres al consumatorului şi dupa ce acesta a confirmat ca a luat cunoştinţa de faptul ca işi va pierde dreptul la retragere dupa executarea completa a contractului de catre profesionist;
– furnizarea de produse sau servicii al caror preţ depinde de fluctuaţiile de pepiaţa financiara pe care profesionistul nu le poate controla şi care pot avea loc pe parcursul perioadei de retragere;
– furnizarea de produse confecţionate dupa specificaţiile prezentate de consumator sau personalizate in mod clar;
– furnizarea de produse care sunt susceptibile a se deteriora sau a expira rapid;
– furnizarea de produse sigilate care nu pot fi returnate din motive de protecţie a sanataţii sau din motive de igiena şi care au fost desigilate de consumator;
– contractele in cazul carora consumatorul a solicitat in mod special profesionistului sa se deplaseze la domiciliul sau pentru a efectua lucrari urgente de reparaţie sau de intreţinere. Daca, cu ocazia unei astfel de vizite, profesionistul presteaza alte servicii in afara celor solicitate in mod expres de consumator sau furnizeaza alte produse decat piesele de schimb indispensabile pentru executarea lucrarilor de intreţinere sau de reparaţie, dreptul de retragere se aplica respectivelor servicii sau produse suplimentare;
– contractele incheiate in cadrul unei licitaţii;
